PLEASE READ through the following TERMS & CONDITIONS as they govern the use, access to my website www.effieanadesign.com (“website”)

If you continue to browse and use this website you are agreeing to comply with and be bound by the following disclaimer, together with my terms & conditions of use.

YOUR ACCEPTANCE
By using and accessing my Website, you agree that:

a) You are over 18 years of age and have the legal capacity to enter into a legally binding Agreement

b) You have read and accepted these Terms & Conditions

c) You will comply with these Terms & Conditions

Your continued use of my Website is deemed acceptance of any modifications or amendment of these Terms.

You may also accept these terms where such an option is made available to you such as click “Accept” or “Agree” or “Buy” or “Book”.

LIMITATION OF LIABILITY
Effie Ana Design shall not be liable in no event to the other for any special consequential, incidental, or indirect damages of any kind (including without limitation, loss of profit) whether or not a party was advised of the possibility of such loss, however caused.

GENERAL DISCLAIMER
You agree to provide complete, correct, current and accurate information, including but not limited of your name, payment details, business/company name, email address, category use of license (pattern print design)

PASSWORD / PATTERN + PRINT LIBRARY
You are responsible for the confidentiality of your password access to the library and not to share with anyone else.

When accessing my Pattern Print Library you acknowledge that the Artwork to be treated as confidential and proprietary information and agree to treat the Artwork as such.

INTELLECTUAL PROPERTY
My website contains intellectual property owned by Effie Ana Design this includes, without limitation, artwork, patterns, graphics, logos, design, content and by third-parties that license content to me including without limitation such as software, mock-ups.

By accessing and using this website, does not grant or transfer any right of ownership, title, copyright or other interest to you.

I reserve the right to immediately remove your access to my website without refund, if you are found to be violating these Terms.

PRIVACY POLICY
Please refer to my privacy policy for further information.

GOVERNING LAW
The terms of use will be governed by those laws of Australia without regard to its conflict of law provisions. In the event for resolving any dispute the exclusive venue shall be in the courts of New South Wales, Australia.

COLOURS & PRINTING
I do my best to ensure that the colours of any products (pattern / print artwork) are accurately displayed on my website, however to note each screen / device displays colour differently.

Printed colours can also vary from printers, run of a print, materials and job due to the nature of printing process. Test printing is recommended prior to production. Effie Ana Design is not responsible for providing printing services. All prices provided in quotations do not include printing costs.

LICENSE - NON-EXCLUSIVE
Where you purchase a pattern or print from my Pattern Print Library, you are granted a Non-Exclusive, non-transferable, license for two (2) years for (1) one category use, for your own business use and for reproduction on consumer goods.

You may not re-sell, copy, create derivative works of, reverse engineer, transfer or assign the Pattern or Print Design to anyone else.

LICENSE TERM
The term of the Agreement License will commence on the Effective Date. At the end of the license term, you will have the opportunity to renew the license. If you decide not to renew the license, then you will no longer be able to use the design on any of your products.

Modification by a business when purchased a non-exclusive Licensed Design(s) is permitted, but ONLY to address formatting such as cropping, resizing. Any design element from within the design MUST NOT be extracted and used in other commercial ways.

No right of ownership, title, copyright or other interest, in and to the Licensed Design(s) and underlying artwork is transferred.

MULTIPLE CATEGORY USE
If you would like to use a Pattern or Print Design across more than (1) one category use, such as Fashion category along with Homeware category for your products, prior to purchase please email me at hello@effieanadesign.com to discuss further.

EXCLUSIVE LICENSE
If you would like an exclusive license (pending on availability of the design) please email me at hello@effieanadesign.com to discuss further.

AMENDMENTS TO PATTERNS OR PRINTS
If you would like an amendment to a Pattern or Print design from my Library, prior to purchase please email me at hello@effieanadesign.com to discuss further.

AGREEMENT
Upon purchasing a pattern from my Pattern Print Library you will immediately receive a download link of the PDF file to your email inbox of your Agreement.

Please download within 24 hours, read it and fill in your name, business name, address, date, category use and sign then email back to me. Once I have received your completed, filled out Agreement your pattern or print design will be sent to you for download within 2 business days (AEST).

REFUNDS
Due to the nature of the product being digital, refunds are not provided.

In the event an issue has occurred with the file I will work with you to resolve accordingly.
